Freedom in Motion

These terms govern purchases of digital artworks from Freedom in Motion and use of this website. Separate commercial licence agreements apply where expressly agreed.
Nothing in these terms excludes or restricts your statutory consumer rights.
1. Business Information
Freedom in Motion is operated by David Green, a sole trader trading as Freedom in Motion, United Kingdom.

2. Our Artworks
Freedom in Motion creates original nature films and releases selected works as limited-edition digital artworks.
Products are digital and delivered electronically. No physical artwork, screen, playback device or installation service is included unless expressly stated.
Please read the product description and any published file-format, compatibility and playback information before purchasing. Contact us if you need clarification.
3. What You Purchase
Purchasing an edition establishes you as the registered collector of a particular numbered digital artwork once the purchase has been processed and the edition allocated.
Your purchase includes the artwork for private display, a certificate of authenticity and a unique QR code linked to its verification record.
You do not acquire copyright or intellectual property rights in the underlying film. These remain with David Green / Freedom in Motion.
4. Permitted Use
You may download and keep the supplied artwork for your own private, non-commercial viewing and display.
You may keep personal backup copies for that permitted use. These copies do not create additional numbered editions or additional ownership rights.
Unless separately authorised in writing, you may not:
Distribute the artwork or provide copies to others.
Upload it to public websites, social platforms or file-sharing services.
Sublicense it or sell copies of the underlying file.
Use it for public or commercial display.
Incorporate it into another commercial product or service.
Commercial display, reproduction and other commercial uses require a separate licence.

5. Editions and Availability
Each limited-edition artwork has a maximum of 50 numbered editions in total.
This total includes editions reserved for collector sets, prizes and other designated allocations. Reserved editions do not increase the edition limit.
Individual purchase availability excludes reserved and already allocated editions. Prices may increase according to the published pricing structure.
Availability information is updated periodically. Concurrent purchases or processing delays may mean an order requires review before an edition can be allocated.
If we cannot fulfil your purchase, we will contact you and arrange an appropriate resolution, including a refund where due. We will not exceed the published edition limit to fulfil an order.
6. Prices and Payment
Prices are shown in GBP (£). Any applicable taxes and additional charges will be disclosed before you complete your purchase.
The price confirmed for your order is the price payable for that purchase. Later price changes do not retrospectively change it.
Payments are processed through the payment providers available at checkout. Freedom in Motion does not store full payment-card details.
7. Delivery
Squarespace supplies a purchase confirmation and delivery-information document.
Your artwork download link, certificate and verification link are sent separately to the email address provided at checkout after allocation and registration.
The delivery-information document is not the artwork or its certificate of authenticity.
Please provide an accurate email address and check your spam or junk folder if the delivery email does not arrive. Contact us with your order number if you need assistance.
8. Cancellation and Refunds
Our Refund Policy forms part of these terms.
For qualifying online consumer purchases, you normally have a 14-day cancellation period.
If you request digital delivery during that period, we must obtain your express consent to begin supply and your acknowledgement that your cancellation right will be lost once supply begins.
That right is lost only when the applicable legal requirements have been met. Accepting these general terms or purchasing a digital product does not, by itself, automatically remove it.
Your statutory rights concerning faulty, misdescribed or otherwise non-conforming digital content remain unaffected.
9. Certificates and Verification
The certificate and QR-linked verification record identify the numbered edition and information held in the Freedom in Motion archive.
Verification supports edition registration, authenticity and registered ownership history. It does not prevent unauthorised copying or establish possession of every digital copy.
A copied file, certificate or QR code does not independently establish registered ownership of an edition.
Contact us if you believe a registration record is incorrect.
10. Resale Eligibility and Service Availability
Editions from Seasons 1 and 2 become eligible for the official resale service once all 45 individually available editions of each of the nine Season 2 artworks have been sold through the primary collection.
The five reserved editions within each artwork’s 50-edition limit are excluded from this condition.
Eligibility does not automatically activate the service. Freedom in Motion must separately open it before resale listings or transactions can be accepted.
The official resale service is currently closed.
Eligibility does not guarantee a buyer, a resale price, a profit or a particular launch date for the service.
11. Ownership Transfers
A private sale or transfer does not automatically update the registered ownership record or authorise redistribution of the artwork file.
Requests to transfer registered ownership must be reviewed and verified by Freedom in Motion. The applicable transfer arrangements and licence conditions must be established before a transfer is completed.
Following a verified transfer, the archive will identify the new registered collector and retain the relevant provenance history.
Previously downloaded files cannot be remotely erased. An outgoing collector’s retention of a file does not, by itself, preserve registered ownership or authorise continued use after transfer. The applicable transfer terms will specify the parties’ rights and obligations.

12. Resale Brokerage
Freedom in Motion charges a 15% brokerage fee on completed sales arranged through its official resale service.
This fee is deducted from the seller’s completed resale price. For example, a £100 completed resale incurs £15 brokerage, leaving £85 payable to the seller before any other applicable charges.
Any additional charges or transaction arrangements will be disclosed before the seller agrees to proceed.
This brokerage does not apply to an original edition purchased directly from Freedom in Motion.
13. Access and Support
Keep your download and delivery links secure and do not share them for unauthorised distribution.
If you lose access or encounter a technical problem, contact us with your order number. We will investigate and provide assistance or an appropriate remedy where required.
A technical access problem does not automatically remove your registered ownership.
14. Liability
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to exercise reasonable care and skill.
For consumer purchases, we supply artworks for private, non-commercial use. We do not accept liability for business losses arising from unauthorised commercial use.
Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.
Your statutory rights concerning digital content, including applicable remedies for damage caused to a device or other digital content, remain unaffected.
15. Changes and Governing Law
Updates to these terms will be published with a revised date. Changes will not retrospectively remove rights arising from an existing purchase.
These terms are governed by the law of England and Wales, subject to any mandatory consumer protections that apply to you.
Nothing in these terms prevents you from bringing proceedings in a court available to you under applicable consumer law.
